Conditions of use digital gift card
The Digital Gift Card is valid for the purchase of the products sold in the 24 shops that Via Moda group has in the Principality of Andorra: Benetton 012, Buick, Desigual, G-Star Raw, Goose&Duck, Hugo Boss, Jack&Jones/Vero Moda, Jeans Culte, Jott, Levi’s, Levi’s Illa, Liu·Jo, Mítics, Napapijri, Now Andorra, Now Escaldes, Options+, Ovs Kids, Ovs Kids Illa, Replay, Shibori, Subdued, Tango and Urban.
The Digital Gift Card is the property of its issuer: Via Moda, S.L., with National Tax Register Number L-705430-D, and registered address at C. de l’ Aigüeta 2-4, AD500 Andorra la Vella, in the Principality of Andorra, and its holder is a mere custodian thereof.
The Digital Gift Card does not have an expiry date.
The Digital Gift Card may be issued for a minimum of €10 and a maximum of €1,000 and it may be redeemed in sales, promotions and special offers.
The monetary balance on the Digital Gift Card cannot be refunded or exchanged for money.
It is not necessary to spend the entire value of the Digital Gift Card in a single purchase. The unused balance will be stored on the card for future purchases. If the total of the purchase is higher than the balance on the Digital Gift Card, the purchaser may complete the purchase using any other available method of payment.
The products purchased using the Digital Gift Card are subject to the same exchange, return and refund policy as the other products purchased at any of the 24 Group Via Moda stores.
The Digital Gift Card is a card made out to the bearer. The use and safekeeping of the card is exclusively the responsibility of the card holder. There will be no replacements for stolen, lost or damaged cards.
Any Digital Gift Card obtained by illicit means will be null and void and cannot be used for the purchase of products, and its value will not be refunded.
Regarding the purchase of the Digital Gift Card, we will not be responsible for the non-receipt or the delay in receipt by the intended recipient for reasons beyond our control. Among others, such reasons include: (1) deficiencies in or the collapse of the telecommunications lines or systems; (2) the delay in the transmission of information or data or any loss of information or data stemming from any of the circumstances described in (1); (3) the inaccuracy of the data of the intended recipient of the Digital Gift Card, provided by the purchaser; (4) if it is impossible to deliver the Digital Gift Card to the email account provided; or (5) if the email sent has been considered spam or undesired mail by the recipient’s server.
The Digital Gift Card shall not be used for advertising or promotional purposes without the prior written authorisation of the Issuer.
The purchase and /or use of the Digital Gift Card implies the full acceptance of these conditions, which have been provided prior to purchase thereof. These General Terms are governed by the laws of Andorra.
Conditions of use physical gift card
The Physical Gift Card is valid in any VIA MODA shop in the Principality of Andorra for buying any article on sale. It can be acquired in all the VIA MODA centres by means of any of the forms of payment accepted by the company. Its non-returnable purchase value is equivalent to the amount shown on the front.
The card is the property of VIA MODA. It is valid for two years from the acquisition date or until the completion of the amount shown during that period. Once it loses its validity, the card cannot be used to purchase any item or to claim the unused balance.
During its two years of life it may be used any number of times as long as it has a positive balance. The balance available on the card is the difference between the balance prior to the moment of making the purchase and the amount of the new purchase. The remaining balance of the card can be consulted at any time by way of the VIA MODA Customer Attention Service. If the available balance is not sufficient to cover the amount of a purchase, payment may be completed by way of the customary methods accepted by the company.
The card is a document granted to the holder, who is responsible for its use at all times. VIA MODA accepts no responsibility for its replacement or reimbursement in the event of unauthorized use, theft, loss, destruction or deterioration or any other circumstance.
Returns of articles purchased with the VIA MODA Physical Gift Card will only be accepted with the presentation of the purchase receipt. The amount will be reimbursed by direct deposit to the balance of the VIA MODA Physical Gift Card or by means of a voucher to the holder.
Any dispute which may arise in relation with the card will be submitted to the courts and the legislation of the Principality of Andorra. The use of the card entails the acceptance of both the conditions stated on its reverse and those set out in this document of general use conditions.
